1. Acceptance of Terms

By accessing or using PromptOps, you agree to be bound by these Terms of Service. If you do not agree, do not use our services.

2. Service Description

PromptOps provides prompt management, optimization, and benchmarking tools for AI applications. We offer free and paid tiers as described on our pricing page.

3. Your Content

You retain ownership of all prompts and content you store in PromptOps. We do not use your content to train AI models or share it with third parties without your explicit consent.

4. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must:

• Be at least 16 years of age to use PromptOps.
• Provide accurate and complete information when creating your account.
• Keep your login credentials secure and notify us immediately of any unauthorized access.
• Not share your account or API keys with unauthorized third parties.

5. Acceptable Use

You agree not to use PromptOps for any unlawful or prohibited purpose. Specifically, you must not:

• Use the service for any illegal activity or to generate harmful, abusive, or deceptive content.
• Reverse engineer, decompile, or disassemble any part of the PromptOps software or infrastructure.
• Attempt to circumvent usage limits, rate limits, or security measures.
• Overload the service with automated requests beyond your plan's fair-use limits.
• Resell or redistribute PromptOps services without our written consent.

We reserve the right to suspend or terminate accounts that violate these terms.

6. Service Availability

PromptOps is provided on an "as-is" and "as-available" basis. While we strive for high uptime, we do not guarantee uninterrupted or error-free service. We may perform scheduled maintenance with reasonable advance notice. We are not liable for any downtime, data loss, or service interruptions beyond our reasonable control.

7. Liability Limitation

To the maximum extent permitted by applicable law:

• PromptOps shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities.
• Our total aggregate liability for any claims arising from your use of the service shall not exceed the total fees paid by you in the 12 months preceding the claim.
• We do not warrant the accuracy or completeness of any AI-generated outputs, optimizations, or benchmark results.

Nothing in these terms limits liability for fraud, gross negligence, or any liability that cannot be excluded by law.

8. Termination

Either party may terminate this agreement at any time:

• By you: You may close your account at any time through your account settings or by contacting support.
• By us: We may suspend or terminate your account if you breach these terms, with notice where practicable.

Upon termination, your right to use the service ceases immediately. We will delete your personal data and prompt content within 30 days, except where retention is required by law. You may request a data export before closing your account.

9. Modifications to Terms

We may update these terms from time to time. For material changes, we will provide at least 30 days' advance notice via email or a prominent notice on our website. Continued use of PromptOps after the effective date constitutes acceptance of the updated terms. If you disagree, you may terminate your account before the changes take effect.

10. Governing Law & Jurisdiction

These terms are governed by the laws of the Federal Republic of Germany. Any disputes arising from or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of [GERICHTSSTAND]. Mandatory consumer protection laws of your country of residence remain unaffected.
